A Bryan man who was accused of rape was sentenced Tuesday to 54 months in prison.
Hugh L. Whitehead, 67, of Bryan, was indicted in December 2019 on charges of rape, a first-degree felony; felonious assault, a second-degree felony; abduction, a third-degree felony; and domestic violence, a fourth-degree misdemeanor.
Online court records show that authorities allege that on Dec. 6, 2019, Whitehead held his victim against her will, “strangled her and digitally penetrated” her.
Last month Whitehead pleaded guilty to the abduction charge and an amended charge of fourth-degree felony assault. The rape and domestic violence charges were dropped as part of a plea agreement.
Williams County Prosecutor Katie Zartman said she was “fairly happy” with the sentence and said getting a conviction on the rape charge would have been “an uphill battle” since the victim didn’t want to testify.
